In case the child misses, or the mother denies giving the child afterwards, private judicial systems are better as in conventional government judiciary, even a simple case may take 10-12 years for a convincing solution.
if judiciary and security is privatized, Contract is the base of justice.
Once the surrogate mothers signs the contract, it becomes legitimate. In case she denies later on, and tries to breach the contract, she can be prosecuted by private security and judiciary system, either she will have to accept maintaining the contract, or she will have to pay the fine, which obviously will depend on the infertile couple’s demand. Obviously, surrogate mother will avoid doing any cheat otherwise she will have to pay huge fine.
<<<<AS per my understanding from your earlier posts on private judicial systems, Both parties needs to agree upon the choice of juries/decisions panel who is suppose to hear the case.
Now, if surrogate mother deliberately decided not to agree on any of the courtes/juries which are chosen by couple to hear their case .....then what should be the way forward for couple?
2)Also, correct me if I am wrong - you mentioned somewhere that "decisions of private judiciary can be challenged in another private courts of one of the parties in dispute not agree with decision made by such courts..now don't think its quite easy to drag the case on and on for years...coz they are just service providing bodies in your "free market system" i.e. in this case service is "justice" so customer is boss and decide to choose another vendor of justice( read - private courts) if he/she is not satisfied with the service(read - justice)? >>>>>>>

I think today there are painkillers/drugs available which can significantly reduce the pain during pregnancy. So I think its not required to look for surrogate mother for such small reason

There can be many reason. Like the CEO of ICICI may not like to waste the most prominent months of her career on a hospital bed. Although she may like to be mother in same period. So she may opt for surrogacy, Its her wish.

What if clinic failed to do so?…whom the couple should contact in case of any discrepancies in records? I am sure you are aware of lot cases where babies are simpley disappearing from clinics either due to corrupt wardboys/nurses who are selling them to wealthy couples

When clinics are responsible, they are free to provide protection and engage private security systems.
No one can avoid accidents, even the normal kids from a house can be kidnapped, that is not the part of discussion. if there are criminals, there are security nets to avoid crimes and catch/punish criminals, private security systems are much better because of efficiency they provide, furthermore, as the number of private security cells is increasing in India, competition is making it viable for even Not so rich hospitals and buildings to provide latest and best security technologies, guards and nets. Seldom people believe in government police and that is why they are looking for private options, specially in cities like Delhi, Mumbai, Bangalore.
In case the child misses, or the mother denies giving the child afterwards, private judicial systems are better as in conventional government judiciary, even a simple case may take 10-12 years for a convincing solution. India strictly needs privatization of judiciary and security forces at large level.
Even trying to look for unsolved cases in indian government courts will make one feel numb, dumb and helpless.

Absolutely. As long as parties involed in contract are honest, self-righteous people. The sanctity of contract will be maintained.

its not so easy to run away and vanish you know. Problem is, in India, contract holds no value, and courts work on corruption and emotions rather than reason. Situation is ridiculous.

it is necessary to involve a good layer to maintain the honesty in the deal.
<<<<<<The word "layer" shud be "lawyer">>>>>>>
Even if she feels strong surge to not to hand over the child, she will need to pay back the money which was invested on her plus a monetary fine as punishment.
<<<<<I think if a surrogate mother somehow changed her mind and decided not to obligate the contract then it will cause irreparable damage to the couple
who invested so much time, money(to provide best mental and physical care to the woman) and emotions in this whole process. So the attitide of "take your money back and I don't want
to give u your baby bcoz I have changed my mind after motherhood" won't make sense. Money is not solution to repair every damage in the world. >>>>>>>
In case of anonymous surrogate mothers, it becomes the clinics duty to make sure that birth certificate holds the name of infertile couple as mother and father, and the clinic is responsible to check the procedures of adoption.
<<<<What if clinic failed to do so?...whom the couple should contact in case of any discrepancies in records? I am sure you are aware of lot cases where babies are simpley disappearing from clinics either due to corrupt wardboys/nurses who are selling them to wealthy couples.>>>>>>>
A well drafted document of agreed contract between surrogate mother and infertile couple should be enough to maintain the sanctity of process
<<<<<<Absolutely. As long as parties involed in contract are honest, self-righteous people. The sanctity of contract will be maintained.>>>>>>
Better option in such cases is donation of strong eggs to the infertile woman. That is, instead of renting a womb, such infertile woman may buy healthy eggs and carry a healthy child in their own womb.
<<<<<<< Instead of doin all this medical thing ..why not just adopt the babies from orphanage? will be quick and easy after few evaluations ..right?>>>>>>
procedures,etc..right?>>>>>>>>>>
There can be chances that some women may adopt of surrogacy just to avoid delivery pains. Although I just do not approve such ideas, yet if some woman opts for having surrogate services to avoid delivery pains,
<<<<<<<I think today there are painkillers/drugs available which can significantly reduce the pain during pregnancy. So I think its not required to look for surrogate mother for such small reason>>>>>>>
I like the info about egg donationa and womb donation and legalities and technicalities involved in that process from indian context.
Thanks for bringing freshness to your artilces by writing on a different topic for a change!
